We are bound by the Australian Privacy Principles (APPs) contained in the Privacy Act 1988, which govern the way we collect, store, use, and disclose personal information in Australia.

When a tracker is installed in your vehicle, our tracking service collects:

• The location of the vehicle, and its trip history
• Vehicle speed
• Events and alerts (e.g., geofence, tamper, tow-away and power-cut alerts)
• Immobiliser status
• Other vehicle data, depending on your product and installation (e.g., ignition status and engine data)

Vehicle and location data is personal information when it can be linked to you or to a person who drives the vehicle. If other people drive a vehicle that has a tracker, you must tell them that the vehicle is tracked.

2. How We Collect Your Information

We collect personal information through different channels, including:

• When you purchase products from us
• When you contact us via email, phone, or our contact form
• When you register or create an account via our payment processor or tracking service website
• From the tracker installed in your vehicle, while your service is active
• From our accredited installers, when an installer fits and activates a tracker for you
• Automatically via cookies or analytics tools when you browse our Website

You can browse our website without telling us who you are. We cannot provide tracking services anonymously, because we must know who owns the account and the tracker.

3. Use of Information

We collect and use your personal information to:

• Provide our tracking and immobilisation services, including live location, trip history, alerts and remote control
• Process transactions, send invoices and deliver physical products
• Perform customer service, including responding to inquiries and troubleshooting
• Improve our services and your online experience
• Send you updates, promotions, or other marketing material (subject to your opt-in consent)
• Comply with legal obligations, including Australian consumer protection and taxation laws
• Monitor the security of our systems and prevent fraud or unlawful activity

You can stop marketing emails at any time. Use the unsubscribe link in the email, or go to our unsubscribe page.

4. Disclosure of Information

• Delivery services (e.g., Australia Post) and payment processors, to complete your purchases
• Our accredited installers, to install, activate and support your tracker
• Service providers that host and operate our website, online store, systems and communications
• Regulatory authorities, police or other agencies, when the law requires or authorises it
• Other parties with your express consent or at your direction (e.g., when you share a live location link)

We do not sell your personal information to any third-party organisations.

5. Data Security

We take reasonable steps to protect your personal information against loss, misuse, unauthorised access, alteration, and disclosure. This includes secure servers, encrypted payment mechanisms, and strict internal digital protocols.

No method of transmission over the internet is 100% secure. You are responsible for keeping the credentials and passwords for your user account safe.

If a data breach is likely to cause you serious harm, we will notify you and the Office of the Australian Information Commissioner (OAIC), as the Notifiable Data Breaches scheme requires.

6. Data Retention

We keep your information only for as long as we need it. When we no longer need it, we delete it or de-identify it.

• Location, trip and event data (including alerts) is deleted automatically after 12 months.
• When your subscription ends or your account is closed, the tracking data for that account is permanently deleted after 90 days.
• Account and billing records are kept for as long as we need them for legal, tax and accounting purposes.

If you sell or transfer a vehicle that has a tracker, contact us at privacy@immotrack.online. We will delete the historical location data for that vehicle. The new owner cannot see your data, because it belongs to your ImmoTrack account, not to the tracker.

You can also ask us to delete your personal information at any time. See section 10.

7. Cookies, Analytics and Advertising

We use cookies and similar technologies to improve your browsing experience, analyse Website traffic, and measure our advertising. Cookies may collect data such as:

• Your device type
• IP address
• Pages visited on our Website

We use Google Analytics to understand how visitors use our Website, and Google Ads to measure our advertising. These services use cookies. Google's use of this data is covered by Google's own privacy policy.

You may disable cookies in your browser settings; however, certain functionality on the Website may become unavailable.

All GPS tracking data, and your account details for our tracking platform, are hosted in Australia and stay in Australia.

10. Accessing, Updating, and Deleting Personal Information

You can ask to see the personal information we hold about you, ask us to correct it, or ask us to delete it. Contact us at privacy@immotrack.online.

We will confirm your identity before we act on a request. We will respond within 30 days, and we do not charge for a request. If we cannot do what you ask (for example, because the law requires us to keep a record), we will tell you why in writing.

We may update this Privacy Policy from time to time to reflect changes in our practices or for legal reasons. The updated policy will be posted on this page with a revised "Effective Date." We encourage you to review this policy periodically.
